The increasing threat of compliance investigation and how employers can avoid it


"Plan/Prevent/Protect" is a Department of Labor initiative that shifts 100% of the burden of compliance to employers. As a DOL agency, the Wage and Hour Division (WHD) will pursue Plan/Prevent/Protect in FY 2013 by increasing outreach to workers while limiting compliance resources to employers. Specifically, WHD will rely on complaint-based targeting and data-driven targeting to identify, investigate and litigate employers found to be non-compliant. The best way to ensure compliance (and mitigate the risk of complaints or investigation) is to build a culture of compliance that includes educating workers and supervisors, creating pro-compliance policies, automating compliance issues with internal systems, conducting and documenting compliance audits, and taking pride in valuing compliance as a business priority.
